Welcome to Pneuma Health. These Terms of Service (“Terms”) govern your access to and use of the Pneuma Health platform, website, and services (collectively, the “Platform”) operated by Pneuma Health, LLC (“Pneuma Health,” “we,” “us,” or “our”). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Telehealth Services
Pneuma Health provides a technology platform that connects patients with licensed healthcare providers for the diagnosis and treatment of sleep-related breathing disorders, including obstructive sleep apnea (OSA). Our services include online health screenings, home sleep apnea testing (HSAT), clinical review by board-certified physicians, and coordination of durable medical equipment (DME) fulfillment.
Pneuma Health does not itself provide medical care. All medical decisions, diagnoses, and prescriptions are made by independently licensed physicians contracted through a managed professional entity. The physician-patient relationship is formed between you and the treating physician, not between you and Pneuma Health.
2. Eligibility
- You must be at least 18 years of age.
- You must reside in a state where Pneuma Health’s affiliated physicians are licensed to practice.
- You must provide truthful and accurate information during registration, intake questionnaires, and any communication with your care team.
- You acknowledge that telehealth services are not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911.
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to enable multi-factor authentication (MFA) as required during registration. Notify us immediately at [email protected] if you suspect unauthorized access to your account.
4. Home Sleep Apnea Testing (HSAT)
If clinically indicated, you may be prescribed a home sleep apnea test. The HSAT device (WatchPAT ONE by Itamar Medical) is an FDA-cleared, single-use diagnostic device shipped directly to your mailing address.
- You agree to follow the device instructions and complete the test as directed.
- The device is single-use and disposable — do not return it.
- Test results are transmitted automatically and reviewed by a board-certified sleep physician.
- Timelines for results may vary based on clinical complexity and physician availability.
5. Prescriptions & DME Fulfillment
If your physician determines that treatment is clinically appropriate, a prescription for positive airway pressure (PAP) therapy or other treatment may be issued. Prescriptions are fulfilled through contracted DME partners and are subject to insurance verification, geographic availability, and clinical appropriateness.
Treatment is prescribed only when clinically indicated. Not all patients who complete the diagnostic process will receive a prescription. Pneuma Health does not guarantee any particular diagnosis or treatment outcome.
6. Payments & Fees
Certain services on the Platform require payment. All fees are displayed before you authorize payment. Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees.
- Screening questionnaires are provided at no cost.
- HSAT device and physician consultation fees are disclosed during the ordering process.
- DME costs may be subject to insurance coverage, copays, or self-pay pricing.
- Refund requests are handled on a case-by-case basis. Contact support for assistance.
7. Privacy & Protected Health Information
Your privacy is critically important to us. Our collection, use, and protection of your personal and health information is governed by our Privacy Policy and applicable federal and state laws, including the Health Insurance Portability and Accountability Act (HIPAA). By using the Platform, you acknowledge that you have read and understand our Privacy Policy.
8. Prohibited Conduct
You agree not to:
- Provide false, misleading, or inaccurate health information.
- Use the Platform for any unlawful purpose or to obtain prescriptions for anyone other than yourself.
- Attempt to access another user’s account or protected health information.
- Interfere with, disrupt, or compromise the security or integrity of the Platform.
- Reverse engineer, decompile, or attempt to derive the source code of the Platform.
9. Intellectual Property
All content, software, trademarks, and intellectual property on the Platform are owned by or licensed to Pneuma Health. You may not reproduce, distribute, or create derivative works from any Platform content without our prior written consent.
10. Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not guarantee any specific health outcome or diagnosis timeline.
11. Limitation of Liability
To the fullest extent permitted by law, Pneuma Health and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid to Pneuma Health in the twelve (12) months preceding the claim.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Pneuma Health from any claims, losses, or damages (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any applicable law.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any reason with reasonable notice. You may deactivate your account by contacting [email protected]. Upon termination, your right to use the Platform ceases, but provisions that by their nature should survive (including Sections 10–14) will remain in effect. Your medical records will be retained as required by applicable law.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Denver, Colorado.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Platform. Your continued use of the Platform after such notification constitutes acceptance of the updated Terms.
